By accessing or using the FITMUSE platform, application, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.
2. Description of Service
FITMUSE provides an AI-powered virtual fitness training and motivational platform. The Service includes personalized workout generation, performance tracking, and interaction with virtual AI trainers (such as "Lexi"). The specific features available may evolve over time.
3. User Eligibility
You must be at least 18 years old to use this Service. By using FITMUSE, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all of the terms and conditions set forth herein.
4. Membership and Payments
Access to FITMUSE during early access phases may be restricted or complimentary as determined by us. Future use of the Service may require a paid subscription. We reserve the right to modify pricing, subscription models, or payment terms at any time with prior notice provided through the platform.
5. Code of Conduct
You agree to use the Service in a manner consistent with any and all applicable laws and regulations. You shall not engage in inappropriate, abusive, or disruptive behavior when interacting with the AI trainers or the platform.
6. Intellectual Property
The Service and its original content, features, functionality, and brand elements (including but not limited to the FITMUSE name, the Lexi character design, and proprietary training protocols) are and will remain the exclusive property of FITMUSE and its licensors.
7. Limitation of Liability & Health Disclaimer
FITMUSE provides fitness information for educational purposes only. You should consult with a physician or other healthcare professional before starting this or any other fitness program. We are not a licensed medical care provider. In no event shall FITMUSE be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions.
